Sergey Grigoryants (12 May 1941 – 14 March 2023) was a Soviet dissident and political prisoner - circa 10 years in GULAG communist concentration camp, from 1975 to 1980 and then four more years starting in 1983 on similar charges. Journalist, in 1987-1991 - editor of the only uncensored media in the USSR which was subject to repeated attacks, Glasnost magazine. Writer, literary critic, and winner of the WAN International Award "Golden Pen of Freedom". Organizer of the conferences "KGB: yesterday, today, tomorrow", human rights activist and President of the Glasnost Defense Foundation for Human Rights. Chairman of the Russian coalition in support of the International Criminal Court; active opponent of the Chechen war. Art collector and humanist.

I, being the chairman of the Russian coalition in support of the International Criminal Court, being also one of the participants of the many years long work on drafting its Charter,
and, being one of the participants of the UN sponsored conference institutionalizing the ICC which was held in Rome on June 15-17, 1998, where its charter, the Rome Statute, was adopted;
and, finally, being a citizen of the Russian Federation who’s convinced that the actions of a number of leaders of my country, especially those perpetrated over the past year, constitute counts of a number of the most serious international crimes: aggression (Paragraph 1 “a” of the Article 5, Part 2 of the Rome Statute), as well as a number of war crimes which fall under the Paragraph 2 of the Article 8 of the Rome Statute and which were committed on the territories of the autonomous republic of Crimea, as well as Donetsk and Luhansk regions, constituent parts of the State of Ukraine.
These crimes were committed on a large scale as part of a plan and policy (Paragraph 1, Art. 8 War Crimes), therefore,
being guided by Article 27 (Irrelevance of official capacity), as well as Art.30 (Mental element) about persons who have intent to commit a criminal act and are criminally responsible under paragraph 2 “a” (In relation to conduct, that person means to engage in the conduct) and “b” (In relation to a consequence, that person means to cause that consequence or is aware it will occur in the ordinary course of events);
being convinced that these acts are not just criminal from the standpoint of international law, but that they have inflicted beyond repair the moral and material damage to the people of the Russian Federation as well as the Russian State as such,
I think it’s imperative that the Prosecutor of the International Criminal Court, using its own powers under Art.15 (proprio motu) and having assessed the evidence presented by the government of Ukraine (paragraph 1, art.14) as well as the numerous freely available evidence of committed crimes (including the interview of the president of the Russian Federation Vladimir Putin given by him personally, of his own free will and under no duress in a documentary Crimea: Path To The Homeland, as well as the statement of the Russia’s Black Sea Commander Fleet Admiral Kasatonov), it’s imperative that the Prosecutor should submit (in accordance with paragraph 3, art.15) to the Pre-Trial Chamber a request for authorization of an investigation.
I also address the president of the International Committee of the Red Cross Mr. Peter Maurer and the executive director of the international organization Human Rights Watch Kenneth Roth, the leaders of the organizations which took very active part in drafting and adopting the ICC Charter as well as in the process of the Russian Federation’s implementation of this Charter
with a request to support both my present address as well as that of the government of Ukraine to the Prosecutor of the International Criminal Court, and to present to the Court all supporting materials they have on the war crimes and crime of aggression committed on the territory of the autonomous republic of Crimea as well as Donetsk and Luhansk regions, constituent parts of the State of Ukraine.

Руководителю международной организации «Хьюман райтс вотч» г-ну Кеннет Роту.
Я — как председатель Российской коалиции в поддержку Международного уголовного суда;
— как один из участников многолетней работы по разработке его Устава;
— как один из участников конференции под эгидой Организации Объединенных наций по учреждению Международного уголовного суда состоявшейся в Риме с 15 июня по 17 июля 1998 года и принявшей ее устав — Римский статут;
— как гражданин Российской федерации, убежденный в том, что действия ряда руководителей моей страны совершенные в частности, в течение последнего года, образуют составы ряда тягчайших международных преступлений — агрессии (пункт «d», статьи 5, части 2 Римского статута), а так же ряд военных преступлений предусмотренных рядом пунктов статьи 8 Римского статута, на территориях автономной республики Крым, а также Донецкой и Луганской областей — частей государства Украина; данные преступления совершены в рамках плана, политики и в крупном масштабе (пункт 1 статьи 8 «Военные преступления» Римского статута Гаагского международного трибунала), а потому в соответствии со статьей 27 («Недопустимость ссылки на должностное положение»), а так же еще и в соответствии со статьей 30 («Субъективная сторона») о лицах имеющих намерение совершить преступное деяние и подлежащих уголовной ответственности, предусмотренной частью 2 пунктов «а» и «б» — «лицо собирается совершить такое деяние» и «в отношении последствия — это лицо собирается причинить это последствие или сознает, что оно наступит при обычном ходе событий»;
— а так же будучи уверен, что эти действия не только являются преступными с точки зрения международных правовых норм, но нанесли непоправимый моральный и материальный ущерб народу Российской Федерации, а так же самому российскому государству, считаю необходимым, чтобы Прокурор Международного уголовного суда, используя собственные прерогативы (proprio motu) (ст. 15 статута), а так же оценив предоставленную ему правительством республики Украина (ст. 14, пункт 1 статута), и имеющиеся ныне в свободном доступе многочисленные доказательства совершенных преступлений (в том числе личное, данное добровольно и без принуждения, интервью президента РФ В.В. Путина в фильме «Крым. Путь на родину», а так же заявления Командующего российским Черноморским флотом адмирала Игоря Касатонова), незамедлительно обратился (в соответствии с пунктом 3 статьи 15 статута) в Палату представительного производства с просьбой дать санкцию на проведение расследования.
Я так же обращаюсь к президенту Международного комитета Красного креста г-ну Петеру Мауреру, и к руководителю международной организации «Хьюман райтс вотч» г-ну Кеннету Роту, — лидерам организаций принимавших самое деятельное участие в разработке и принятии Устава Международного уголовного суда, а так же в процессе имплементации Российской Федерацией упомянутого Устава, с просьбой поддержать как и мое данное обращение, так и правительства республики Украина к Прокурору Международного уголовного суда, а так же передать в распоряжение высокого суда все имеющиеся у них документальные материалы о совершении военных преступлений и преступления агрессии, произведенных на территории автономной республики Крым, а так же Донецкой и Луганской областей, частей украинского государства Украины.

Io - nella qualità presidente della Coalizione russa a sostegno della Corte penale internazionale;
- come uno dei partecipanti al lavoro a lungo termine sullo sviluppo della sua Carta;
- come uno dei partecipanti alla conferenza sotto gli auspici delle Nazioni Unite sull'istituzione della Corte Penale Internazionale tenutasi a Roma dal 15 giugno al 17 luglio 1998 e ne ha adottato lo statuto - lo Statuto di Roma;
- in qualità di cittadino della Federazione Russa, convinto che le azioni di un certo numero di leader del mio paese commesse, in particolare, durante l'ultimo anno, costituiscano gli elementi di alcuni dei più gravi crimini internazionali - aggressione (paragrafo "d", 5, comma 2, dello Statuto di Roma), e quindi una serie di crimini di guerra previsti da alcuni commi dell'articolo 8 dello Statuto di Roma, nei territori della Repubblica Autonoma di Crimea, nonché di Donetsk e Luhansk regioni - parti dello stato dell'Ucraina; tali crimini sono commessi nell'ambito di un piano, di una politica e su larga scala (comma 1 dell'articolo 8 "Crimini di guerra" dello Statuto di Roma del Tribunale internazionale dell'Aia), e quindi in conformità con l'articolo 27 ("Inammissibilità del riferimento alla posizione ufficiale"), nonché ai sensi dell'articolo 30 ("Parte soggettiva") sulle persone che hanno l'intenzione di commettere un atto criminale e sono soggette alla responsabilità penale prevista nella parte 2 dei paragrafi "a" e "b ” - “la persona sta per commettere un tale atto” e “per quanto riguarda le conseguenze, questa persona intende causare questo effetto o è consapevole che si verificherà nel normale corso degli eventi”;
- ed essendo anche sicuro che queste azioni non sono solo criminali dal punto di vista delle norme legali internazionali, ma hanno causato danni morali e materiali irreparabili al popolo della Federazione Russa, nonché allo stesso Stato russo, lo considero necessario che il Procuratore della Corte Penale Internazionale, avvalendosi delle proprie prerogative (proprio motu) (art. 15 dello statuto), oltre ad accertare le numerose prove dei reati commessi (comprese quelle personali, rilasciate volontariamente e senza coercizione, un colloquio con il Presidente della Federazione Russa v. v. putin nel film "Crimea. Way home", nonché dichiarazioni del comandante della flotta russa del Mar Nero, ammiraglio Igor Kasatonov), immediatamente applicate (ai sensi del paragrafo 3 dell'articolo 15 dello statuto ) alla Camera dei procedimenti rappresentativi chiedendo l'autorizzazione a svolgere un'indagine.
Faccio appello anche al Presidente del Comitato Internazionale della Croce Rossa, sig. Peter Maurer, e al capo dell'organizzazione internazionale Human Rights Watch, sig. Kenneth Roth, ai leader delle organizzazioni che hanno avuto la parte più attiva nella sviluppo e adozione dello Statuto della Corte penale internazionale, nonché nel processo di attuazione da parte della Federazione Russa della suddetta Carta, con la richiesta di sostenere sia il mio attuale appello che il governo della Repubblica di Ucraina al Procuratore di la Corte penale internazionale, nonché di mettere a disposizione dell'Alta corte tutto il materiale documentario in loro possesso sulla commissione di crimini di guerra e crimini di aggressione prodotto sul territorio della Repubblica autonoma di Crimea, nonché nelle regioni di Donetsk e Luhansk, parti dello stato ucraino dell'Ucraina.
